Obligation to sell in the Portuguese islands

If you sell in Portuguese territory, you must also offer sales and delivery in its autonomous regions, such as Madeira and the Azores. You cannot exclude these areas for geographical reasons.

1️⃣ What obligation you must comply with

If you sell in Portugal, you must provide delivery conditions for the entire Portuguese national territory, including its autonomous regions.

Important: you cannot block, restrict or exclude orders from customers in the Portuguese islands solely because of their geographical location.
2️⃣ What the regulation allows

The regulation allows different delivery conditions depending on the geographical destination, especially regarding delivery costs.

This means you may apply different shipping costs for mainland Portugal, Madeira or the Azores, provided that they are justified and do not indirectly prevent the sale.

3️⃣ What you must not do
  • Do not exclude Madeira or the Azores if you sell in Portugal.
  • Do not block orders because of the customer’s residence or location within Portuguese territory.
  • Do not apply disproportionate or unjustified shipping costs to avoid selling in the islands.
  • Do not set delivery conditions that, in practice, prevent the customer from completing the order.
Remember: an exaggerated increase in shipping costs, if it cannot be justified, may be considered an abusive practice or contrary to good faith.
